COLORADO STRONG CHALLENGE
WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION & MEDIA AGREEMENT

Parties and event covered
This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant,” “I,” “me,” or “my”), and covers participation in any and all activities related to the “Colorado Strong Challenge” and any related training sessions, demonstrations, travel between venues, and event-weekend activities (collectively, the “Event”).

This Agreement is made for the benefit of, and releases from liability, the following persons and entities (collectively, the “Released Parties”):

• Sandi Griffin, Sandi Griffin Fitness, and the Colorado Springs Health & Fitness Expo, including owners, officers, directors, employees, contractors, agents, representatives, affiliates, successors, and assigns
• Lion’s Lair Pro Gym and CrossFit Falcon View, including owners, officers, directors, employees, contractors, agents, representatives, affiliates, successors, and assigns
• Great Wolf Lodge (Colorado Springs) and the Event venue(s) and property owner(s)/manager(s), including their owners, operators, officers, directors, employees, contractors, security, and agents
• Air O Sport and/or any Air O Sport equipment providers, vendors, and affiliates
• Any coaches, judges, officials, scorekeepers, medical or first-aid personnel, photographers/videographers/drone operators, vendors, exhibitors, sponsors, volunteers, and event staff supporting the Event
• Any other facility, location, or sponsor involved with the Event (whether listed or not), and their owners/operators and personnel

Acknowledgment of inherent risks
I understand and acknowledge that the Event involves vigorous physical activity and may include, without limitation, strength and conditioning exercises, agility/reflex drills, running/sprinting, lifting, pushing/pulling sleds, TRX suspension work, battle ropes, bench press, neuromuscular stimulation training (including Neubie), throwing/target games (including Air O Sport), participation in crowded public settings, and use of gym and sports equipment.

I understand these activities involve inherent and non-inherent risks, dangers, and hazards that can cause serious injury, illness, permanent disability, paralysis, death, property damage, and other losses. These risks include, without limitation:

• Overexertion; fatigue; dizziness; fainting; dehydration; heat/cold stress
• Muscle, tendon, ligament injuries; strains/sprains; joint injuries; back/neck injuries
• Cuts, abrasions, bruises; impact injuries from equipment or other participants
• Falls, slips, trips, collisions; uneven surfaces; equipment malfunction or misuse
• Cardiovascular events including heart attack, stroke; respiratory events; asthma complications
• Rhabdomyolysis or other exertional complications
• Risks related to neuromuscular electrical stimulation (Neubie) including skin irritation, discomfort, cramping, or other adverse responses
• Risks associated with mobility devices and adaptive equipment, including wheelchair tipping, falls during transfers, hand/finger injuries, and overuse injuries
• Exposure to communicable illnesses in public/event settings
• Risks arising from the acts or omissions of other participants, spectators, volunteers, and staff

I understand that no amount of care, caution, instruction, supervision, or expertise can eliminate all risks.

Neubie / Electrical Stimulation Contraindication Acknowledgment

I understand that certain Event activities may involve neuromuscular electrical stimulation devices (including Neubie). I acknowledge that electrical stimulation may not be appropriate for individuals with certain medical conditions.

Voluntary participation and responsibility for condition
I affirm that my participation is voluntary. I am solely responsible for determining whether I am physically, mentally, and medically able to participate safely in the Event, including on the day(s) of participation.

I represent and warrant that:
• I am in adequate physical condition to participate, and I have not been advised against vigorous exercise by a medical professional (or, if I have, I will not participate).
• I will disclose to Event staff any relevant limitations that could materially affect safety (e.g., injuries, conditions, restrictions, contraindications for electrical stimulation) and I understand staff may restrict or modify my participation for safety.
• I understand it is my responsibility to warm up appropriately, hydrate, and stop if I experience pain, dizziness, chest discomfort, shortness of breath beyond normal exertion, or other concerning symptoms.

Assumption of risk
I knowingly and freely assume all risks, known and unknown, foreseeable and unforeseeable, related to my participation in the Event, including risks arising from the negligence of the Released Parties to the fullest extent permitted by law (except as prohibited by law, such as gross negligence or willful misconduct where applicable).

Release of liability
In consideration of being permitted to participate in the Event, I hereby release, waive, and forever discharge the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to any injury, illness, death, disability, property damage, or other loss that I may suffer, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

This release includes, without limitation, claims arising from:
• Participation in any Event activities, including training and warm-ups
• Use of facilities, equipment, and premises at any Event location
• Travel or movement between stations/venues during the Event
• Decisions regarding Event rules, judging, scoring, scheduling, or participation eligibility
• Actions or omissions of other participants, spectators, volunteers, staff, contractors, or vendors

Indemnification and hold harmless
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or related to:
• My participation in the Event
• My acts or omissions, including any violation of Event rules or instructions
• Any damage I cause to persons or property
• Any claim brought by or on behalf of any third party arising from my participation

Medical treatment authorization
If I become injured or ill during the Event, I authorize Event staff to obtain or provide emergency medical care, including first aid, emergency medical services, and transportation, as deemed necessary in their discretion. I understand that I am responsible for all costs associated with medical treatment, transport, and care, and I release the Released Parties from liability for providing or failing to provide such care, to the fullest extent permitted by law.

Rules, judging, and disqualification
I agree to follow all Event rules, movement standards, safety instructions, and directions from judges, staff, and volunteers. I understand that judges’ calls and Event Director/Head Judge decisions are final. I understand I may be removed or disqualified for safety reasons, unsportsmanlike conduct, or rule violations, and that removal/disqualification may occur without refund, at Event discretion.

Refund / No-Refund Policy
I understand and agree that all registration fees are non-refundable.

No refunds will be issued for:
• Voluntary withdrawal
• Injury prior to or during the Event
• Disqualification or removal from competition
• Failure to attend scheduled heats
• Event cancellation, postponement, modification, or relocation due to weather, venue issues, force majeure, or circumstances beyond organizer control

Registration transfers are not guaranteed and are at Event discretion.

Equipment and personal property
I understand that equipment is used at my own risk. I agree to inspect equipment and notify staff of any unsafe conditions. I accept responsibility for my personal property and release the Released Parties from liability for loss, theft, or damage to personal items.

Photography, video, drone, and media release
I grant the Released Parties the irrevocable right to photograph, film, record, and otherwise capture my likeness, voice, name, and performance during the Event, including aerial drone footage where permitted by law and venue policy.

I acknowledge that drone equipment may operate overhead during portions of the Event.

I agree to comply with all venue policies, including safety and media policies established by Lion’s Lair Pro Gym, CrossFit Falcon View, and Great Wolf Lodge.

I waive any right to inspect or approve the finished product and release the Released Parties from any claims arising from such media use, including claims for invasion of privacy, defamation, or right of publicity, except as prohibited by law.

Great Wolf Lodge Expo Finals Acknowledgment
If I qualify for or participate in the Championship Round held at Great Wolf Lodge, I acknowledge that:

• The venue is a public, family-oriented environment
• Public spectators and hotel guests may be present
• I must comply with all Great Wolf Lodge rules and staff instructions
• I accept risks associated with competing in a hotel/event space setting

Minors (Teen Division) parental/guardian consent and supervision
This section applies if the Participant is under 18.

I understand that Teen Division participation requires a legal parent/guardian to be present for the entire duration of all competition events. No parent/guardian present means no competition participation.

The undersigned parent/legal guardian (“Guardian”) represents and warrants that:
• I am the legal parent or legal guardian of the minor Participant and have authority to sign this Agreement.
• I consent to the minor’s participation and agree to remain present as required.
• I assume full responsibility for the minor’s health and safety.
• On behalf of myself and the minor, I agree to all terms of this Agreement, including release, assumption of risk, indemnification, and media release, to the fullest extent permitted by law.
• I agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor Participant.

Adaptive equipment and assistance
I understand adaptive equipment (e.g., grips, gloves, straps, stabilization) may be permitted for wheelchair and adaptive athletes. I acknowledge that transfers and stabilization assistance may be provided by volunteers or staff if necessary, and I accept the risks associated with those activities. I understand that the Event may assess range-of-motion or movement parameters for certain events and that such determinations are for safety and standardization.

COVID/illness and communicable disease acknowledgment
I acknowledge the risk of exposure to contagious diseases in public and event settings. I agree not to attend or participate if I am symptomatic or have been advised to isolate. I assume all risks related to exposure and waive claims against the Released Parties to the fullest extent permitted by law.

Severability
If any portion of this Agreement is found invalid or unenforceable, the remaining portions shall remain in full force and effect.

Entire agreement
This Agreement constitutes the entire agreement regarding liability release and supersedes any prior discussions or representations. I acknowledge that no oral statements or promises have been relied upon.
